Terms and Conditions

  1. The technician of Mas Air Home Comfort Inc. (the “Company”) attends the Customer’s property and tests the unit (the “Unit Testing”) that the technician of the Company will work with when installing the Products. The Unit Testing will be performed by the technician of the Company prior to the installation of the Products and after the completion of installation of the Products for the purpose of confirming that the unit is in working order before and after the services of the Company. The Company shall not be liable for any unit malfunction claims made by the Customer after the completion of the installation of the Products if the Unit Testing confirms that the unit is in working order before and after the services of the Company.
  2. The Customer and the technician of the Company who attends the Customer’s property will determine the particulars in relation to the installation of the Products prior to the installation. The Company will install the Products pursuant to such particulars determined by the parties. If the Customer requests any reinstallation after the completion of installation of the Products for any reason, then the Company will charge an additional services fee for such reinstallation.
  3. The Company is not a manufacturer of the Products and makes no representations, warranties or conditions as to the performance of the Products. The warranty provided by the manufacturer covers the products. The Company shall not be liable for any loss, damage, or injury of any type (including but not limited to as a result of any water leakage) arising out of or related to or caused or contributed to in any way by the use and operation of the Products or any indirect, incidental, special or consequential damage even is reasonably foreseeable. The Customer expressly agrees to pursue any such claims in relation to the Products against the manufacturer or on any insurance policy for which the Customer is the beneficiary.
  4. The Company shall not be liable for any repairing costs in relation to any minor dents or scratches (such as dents and scratches that are less than one inch in width and/or one-inch depth) caused to the walls, floors or furniture of the Customer’s property during the process that technician of the Company transports and installs the Products.
  5. The Customer may cancel this Services Agreement within ten days after receiving an executed copy. To cancel this Services Agreement, the Customer must give the Company a written notice of cancellation at the address set out in this Services Agreement. However, the Customer loses the right to cancel this Services Agreement if the Customer has accepted the Company’s delivery of the Products to the Customer’s property and installation of the Products has commenced within ten days after the date of execution of this Services Agreement.

ACKNOWLEDGMENT

The Customer acknowledges that the Customer contacted Mas Air Home Comfort Inc. (the “Company”) to invite its technician to the Customer’s property to purchase and install the Products. No unsolicited door-to-door marketing and contracting are incurred between the Customer and the Company.

Invoice Policy

  1. The Company will charge the Customer interest of one percent per month (12% per year) on the balance of any invoices that remain unpaid for more than 30 days. The Company will advise the Customer in advance if the Company changes the interest rate for any unpaid arrears for the Company’s invoices.
  2. Upon the completion of installation of the Products by the Company at the Customer’s property, the Company has all its rights to register a security interest on the title to the Customer’s property if the Customer fails to make a full payment for the services provided by the Company pursuant to terms of the Services Agreement.
